Terms of Service

These terms are a plain-language agreement between you and Cirdia Global S.L. ("Cirdia," "we," "us"). They cover all Cirdia products and services: our mobile apps, wearable devices, websites, and related services.

By using any Cirdia product or service, you agree to these terms and our App Privacy Policy.

1. Who We Are

Cirdia Global S.L. is a wellness technology company based in Spain. We build software and devices that help people understand their wellness patterns through private, personal intelligence — not by collecting and centralizing their health data.

2. Our Products

Mobile apps

  • Tapestry — a personal wellness journal with weekly pattern intelligence (available now for iOS and Android).
  • Nourish — food context integrated into your wellness journal (coming soon).
  • Groundwork — movement and training tracking within your wellness journal (coming soon).

Wearable devices

  • Contour (daytime) and Noir (nighttime) are in development. When available, they'll sync with the Tapestry app and be processed locally on your phone.

Websites and services — our websites (cirdia.com and related subdomains), the Partner Hub, and any other online services we provide.

3. Accounts and Access

  • You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or subscribe.
  • We use magic sign-in links for authentication — there are no passwords in our system. Keep your access to your email secure, and don't share your sign-in links.
  • One account per person. Don't create accounts for others without their knowledge.

4. Subscriptions and Payments

  • Some products require a paid subscription. Pricing is shown before you buy.
  • Purchases are made through the Apple App Store or Google Play. They process the payment; we never see or store your card details. We receive only whether your access is active.
  • Subscriptions renew automatically through the store at the end of each billing period until you cancel.
  • Manage or cancel anytime in your App Store or Google Play subscription settings. Cancellation takes effect at the end of your current period — you keep access until then.
  • Renewal reminders: for annual subscriptions, we'll email you before your renewal date so it's never a surprise.
  • Price changes follow the app stores' rules, which ask for your agreement where required. Changes don't affect your current billing period.
  • Refunds are handled by the App Store and Google Play under their own policies. Contact support@cirdia.com and we'll help where we can.

EU right of withdrawal. If you're in the EU, you have a 14-day right to withdraw from a digital purchase without giving a reason. When you start your subscription and begin using the service, you agree to immediate access and acknowledge that this waives your 14-day withdrawal right. If you haven't used the service, a refund is requested through the App Store or Google Play.

5. Your Data, Your Device

The short version: your wellness data stays on your device — we don't store your health data on our servers, and we can't read it. Your weekly insights are generated privately and your data is never retained by us. You can export or delete your data anytime in the app. For the full picture, see our App Privacy Policy.

6. What You Can and Can't Do

You can: use our products for your personal wellness, export your data, share your reports with your practitioner or anyone you choose, and cancel anytime.

Please don't: reverse-engineer our software (except where law allows, or where our device algorithms are published as open source); use our services to harm, harass, or violate others' privacy; access other users' accounts or data; use automated tools to scrape our services; resell or redistribute our services without permission; or circumvent security or access controls.

7. Wellness Practitioners (Partners)

If you use Cirdia as a wellness practitioner through our Partner Hub, the Partner Terms & Privacy Policy applies in addition to these terms. In short: you're responsible for your own relationship with your clients (Cirdia provides tools, not clinical advice); your profile information is shown to your clients; you receive a referral link you may share but not misrepresent; and partner access is subject to approval and may be revoked for violations.

8. Wearable Devices

If you purchase a Cirdia wearable device (Contour or Noir):

  • Not medical devices. They're wellness tools, not intended to diagnose, treat, cure, or prevent any disease. Don't rely on them for medical decisions.
  • Limited warranty. One-year limited warranty against manufacturing defects from purchase. Normal wear, water damage beyond rated specs, and physical damage aren't covered.
  • Open-source algorithms. The algorithms that process data from our wearable devices are open source and auditable.
  • Firmware updates. We may provide updates to improve functionality or security; we recommend installing them and won't force them without your knowledge.

9. Intellectual Property

  • Our software, designs, brand, and content are owned by Cirdia Global S.L. or our licensors.
  • Your data is yours. We don't claim ownership of anything you create, track, or store.
  • Where we publish open-source code (including wearable device algorithms), those components are governed by their respective open-source licenses.
  • "Cirdia," "Tapestry," "Nourish," "Groundwork," "Contour," and "Noir" are trademarks of Cirdia Global S.L.

10. Disclaimers

  • Wellness, not medicine. Our products provide wellness information and pattern insights — not medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider for medical decisions.
  • No guarantees. We provide our services "as is." We work hard to keep everything running and accurate, but can't guarantee uninterrupted service or that our analysis catches every pattern.
  • Wearable accuracy. Sensor data from wearable devices is approximate and shouldn't be relied on for medical or safety-critical purposes.

11. Limitation of Liability

To the maximum extent permitted by law, Cirdia's total liability for any claims arising from your use of our products or services is limited to the amount you paid us in the 12 months before the claim arose. We're not liable for indirect, incidental, special, consequential, or punitive damages, including loss of data on your device (which is why we encourage regular backups). Nothing here limits liability that can't be limited by law, including for fraud or gross negligence.

12. Changes to These Terms

We may update these terms. If we make significant changes, we'll notify you by email or a prominent notice on our website at least 30 days before they take effect. Continued use after changes take effect means you accept the updated terms.

13. Governing Law and Disputes

These terms are governed by the laws of Spain, and disputes will be resolved in the courts of Valencia, Spain. If you're a consumer in the EU, you can also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

14. Termination

  • By you: stop using our services and delete your account anytime.
  • By us: we may suspend or terminate your account if you violate these terms, with notice where practical. If we discontinue a service entirely, we'll give reasonable notice and a chance to export your data.

15. General

  • If any part of these terms is unenforceable, the rest remains in effect.
  • Our failure to enforce a provision doesn't waive our right to enforce it later.
  • These terms, together with our App Privacy Policy, are the entire agreement between you and Cirdia regarding our services.
