Terms of Service

These terms are a plain-language agreement between you and Cirdia Global S.L. ("Cirdia," "we," "us"). They cover all Cirdia products and services: our mobile apps, wearable devices, websites, and related services.

By using any Cirdia product or service, you agree to these terms and our Privacy Policy.

1. Who We Are

Cirdia Global S.L. is a wellness technology company based in Spain. We build software and devices that help people understand their wellness patterns through private, personal intelligence — not by collecting and centralizing their health data.

2. Our Products

Mobile Apps

  • Tapestry — a personal wellness journal with weekly pattern intelligence (available now for iOS and Android)
  • Nourish — food context integrated into your wellness journal (coming soon)
  • Groundwork — movement and training tracking within your wellness journal (coming soon)

Wearable Devices

  • Contour — a daytime wearable for movement and activity
  • Noir — a nighttime wearable for sleep and recovery

Both devices are currently in development. When available, they will sync with the Tapestry app and be processed locally on your phone.

Websites and Services

Our websites (cirdia.com and related subdomains), subscription portal, partner hub, and any other online services we provide.

3. Accounts and Access

  • You must be at least 18 years old (or the age of majority in your jurisdiction) to use our services.
  • You're responsible for keeping your access credentials (magic links, activation codes) secure. Don't share them.
  • We use magic links and activation codes for authentication — there are no passwords in our system.
  • One account per person. Don't create accounts for others without their knowledge.

4. Subscriptions and Payments

  • Some of our products require a paid subscription. Pricing is displayed before you purchase.
  • Payments are processed by Stripe. We never see or store your payment card details.
  • Subscriptions renew automatically at the end of each billing period unless you cancel. By subscribing, you authorize recurring charges at the displayed price until you cancel.
  • Renewal reminders: For annual subscriptions, we'll email you 30 days before renewal. For monthly subscriptions, we'll send a reminder quarterly. These emails will include your renewal date, amount, and how to cancel.
  • You can cancel anytime through your account. Cancellation takes effect at the end of your current billing period — you keep access until then.
  • We may change pricing with reasonable notice. Price changes don't affect your current billing period.
  • Refunds are handled on a case-by-case basis. Contact [email protected].

EU Right of Withdrawal

If you're in the EU, you have a 14-day right to withdraw from a digital purchase without giving a reason. However, when you activate your subscription and begin using the service, you consent to immediate access to digital content and acknowledge that this waives your 14-day withdrawal right. If you don't activate or use the service within the 14-day period, you can request a full refund by contacting [email protected].

5. Your Data, Your Device

This is the core of how Cirdia works:

  • Your wellness data stays on your device. We do not store your health data on our servers. Symptoms, habits, heart rate, sleep, temperature, mood, energy, cycle, movement — all of it lives in your app's local database, not ours.
  • Pattern intelligence is ephemeral. When we analyze your data to generate your weekly report, it happens in a temporary instance that is destroyed immediately after. We never retain your health data.
  • Wearable integrations are one-way. If you connect Apple HealthKit or Google Health Connect, data flows into your app. It never flows back to those platforms, and it never flows to us.
  • Cirdia device data stays local. Data from Contour and Noir wearables is processed on your phone. It is not sent to our servers.
  • You can export or delete your data at any time through the app settings.

6. What You Can and Can't Do

You can:

  • Use our products for your personal wellness
  • Export your data
  • Share your reports with your wellness practitioner or anyone you choose
  • Cancel anytime

Please don't:

  • Reverse engineer, decompile, or disassemble our software (except where prohibited by law, or where our device algorithms are published as open source)
  • Use our services to harm, harass, or violate others' privacy
  • Attempt to access other users' accounts or data
  • Use automated tools to scrape or access our services
  • Resell or redistribute our services without permission
  • Circumvent security measures or access controls

7. Wellness Practitioners (Partners)

If you use Cirdia as a wellness practitioner through our Partner Hub:

  • You're responsible for your own relationship with your clients. Cirdia provides tools, not clinical advice.
  • Your public profile information (practice name, credentials, bio, location) is displayed publicly. You control what you provide.
  • You receive a unique referral link. You may share it, but you may not misrepresent your relationship with Cirdia.
  • Practitioner access is subject to approval and may be revoked if these terms are violated.

8. Wearable Devices

If you purchase a Cirdia wearable device (Contour or Noir):

  • Not medical devices. Our wearables are wellness tools. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease. Do not rely on them for medical decisions.
  • Limited warranty. We provide a one-year limited warranty against manufacturing defects from the date of purchase. Normal wear and tear, water damage beyond rated specifications, and physical damage are not covered.
  • Open source algorithms. The algorithms that process data from our wearable devices are open source and auditable. You can inspect what runs on your device.
  • Firmware updates. We may provide firmware updates to improve functionality or security. We recommend installing these, but we won't force them without your knowledge.

9. Intellectual Property

  • Our software, designs, brand, and content are owned by Cirdia Global S.L. or our licensors.
  • Your data is yours. We don't claim ownership of anything you create, track, or store.
  • Where we publish open source code (including wearable device algorithms), those components are governed by their respective open source licenses.
  • "Cirdia," "Tapestry," "Nourish," "Groundwork," "Contour," and "Noir" are trademarks of Cirdia Global S.L.

10. Disclaimers

  • Wellness, not medicine. Our products provide wellness information and pattern insights. They are not medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider for medical decisions.
  • No guarantees. We provide our services "as is." While we work hard to keep everything running and accurate, we can't guarantee uninterrupted service or that our analysis will catch every pattern.
  • Wearable accuracy. Sensor data from wearable devices is approximate. It should not be relied upon for medical or safety-critical purposes.

11. Limitation of Liability

To the maximum extent permitted by law, Cirdia's total liability to you for any claims arising from your use of our products or services is limited to the amount you paid us in the 12 months before the claim arose.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of data on your device (which is why we encourage regular backups).

Nothing in these terms limits liability that cannot be limited by law, including liability for fraud or gross negligence.

12. Changes to These Terms

We may update these terms. If we make significant changes, we'll notify you by email or prominent notice on our website at least 30 days before they take effect. Continued use of our services after changes take effect means you accept the updated terms.

13. Governing Law and Disputes

These terms are governed by the laws of Spain. Any disputes will be resolved in the courts of Valencia, Spain.

If you're a consumer in the EU, you also have the right to use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

14. Termination

  • By you: You can stop using our services and delete your account at any time.
  • By us: We may suspend or terminate your account if you violate these terms, with notice where practical. If we discontinue a service entirely, we'll give you reasonable notice and the opportunity to export your data.

15. General

  • If any part of these terms is found unenforceable, the rest remains in effect.
  • Our failure to enforce a provision doesn't waive our right to enforce it later.
  • These terms, together with our Privacy Policy, are the entire agreement between you and Cirdia regarding our services.
